Terms of Service for TypeHero.ai

Effective Date: February 19, 2026

Welcome to TypeHero.ai by Neural Banana LLC (“Service”), a web-based SaaS platform operated by Neural Banana LLC (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

These Terms are intended for general business use, including by travel and hospitality businesses (e.g., hotels, vacation rentals, travel agencies, tour operators, cruise operators, and destination marketing organizations). If you use the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms, and “you” includes that organization.

1. Definitions

Account means the user account you create to access the Service.
Authorized User means any person you allow to access and use the Service under your Account (e.g., an employee or contractor), subject to your plan limits.
Customer Content means any data, text, prompts, instructions, files, images, brand assets, or other content you (or your Authorized Users) submit to the Service.
Output means any content generated by the Service, including AI-generated text or other generated materials, based on Customer Content.
Plan means the subscription tier or package you select.
Usage means consumption of the Service’s features or resources. Usage may be measured by seats, credits, generations, requests, tokens, characters, projects, or similar units as described in the Service, at checkout, or in an order confirmation.
Credits means prepaid or included units of Usage that can be consumed to access certain features, including AI content generation. Credits are not currency, have no cash value, and are not legal tender.
Consumer means an individual purchasing primarily for personal, family, or household purposes (not in the course of trade, business, craft, or profession).

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account, including actions taken by Authorized Users.

You agree to provide accurate, complete, and current information and to update it as necessary.

You must promptly notify us at support@typehero.ai if you suspect unauthorized access to or misuse of your Account.

4. License, Acceptable Use, and Operational Controls

4.1 License

Subject to your compliance with these Terms and any Plan limits, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal business purposes during the term of your subscription or access.

4.2 Acceptable Use

You agree not to:

Copy, modify, or create derivative works of the Service (except to the extent enabled through normal Service functionality)
Reverse engineer, decompile, or disassemble the Service, or attempt to discover underlying source code, models, or system prompts (except to the extent prohibited by law)
Use the Service to build or train a competing product or service
Interfere with the Service’s operation or security, or bypass access controls
Access the Service using automated means (bots, scrapers, crawlers) except where we expressly provide an API and permit such access
Upload malware or harmful code, or use the Service to conduct unlawful activity
Submit Customer Content that you do not have the right to use, or that violates confidentiality, privacy, or intellectual property rights

4.3 Rate Limits, Usage Caps, Metering, and Throttling

To protect service reliability and manage compute costs, we may apply operational controls such as:

Usage caps or plan limits (including per-seat limits)
Rate limits (limits on request frequency)
Metering of Usage and Credits
Throttling or temporary restrictions during unusual spikes, suspected abuse, or technical issues

You are responsible for all Usage and Credits consumed under your Account (including by Authorized Users).

5. AI Features and Output Disclaimers

The Service may include AI-assisted features that generate Output from Customer Content.

You acknowledge and agree that:

Output may be inaccurate, incomplete, misleading, non-unique, or unsuitable for your intended purpose.
You are solely responsible for reviewing, editing, verifying, and validating Output before using or publishing it.
The Service does not provide legal, regulatory, tax, financial, or professional advice.

You are solely responsible for decisions made, actions taken, and outcomes resulting from your use of the Service or Output.

6. Travel and Hospitality-Specific Disclaimers (Pricing, Availability, Advertising Compliance)

The Service is a content and workflow tool. It is not a booking engine, inventory system, ticketing platform, travel agency, or travel supplier.

You are solely responsible for verifying travel-related information before publishing or using Output, including:

Prices/rates, taxes, fees, resort fees, surcharges, and “from” price claims
Availability/inventory, blackout dates, inclusions, restrictions, and fare/room rules
Cancellation, refund, change policies, and terms imposed by your property, suppliers, partners, or local law
Required disclosures and substantiation for marketing/advertising claims

You represent and warrant that any marketing or advertising you create or publish using the Service will comply with applicable advertising and consumer protection laws and codes (including requirements that advertising be truthful and not misleading).

7. Third-Party Services and Integrations

The Service may interoperate with third-party software, platforms, or services (each, a “Third-Party Service”). Your use of a Third-Party Service is governed by your agreement with that provider.

We do not control Third-Party Services and are not responsible for their availability, security, functionality, or terms. We may modify or discontinue integrations at any time.

8. Content, Intellectual Property, Ownership, and No-Training Statement

8.1 Service IP

All intellectual property rights in the Service (including software, text, images, trademarks, and logos) are owned by the Company or its licensors. No rights are granted except as expressly stated in these Terms.

8.2 Customer Content

You retain ownership of Customer Content. You grant us a limited, worldwide, non-exclusive license to host, process, transmit, and use Customer Content solely to provide, maintain, secure, and improve the Service.

8.3 Output

As between you and the Company, you own Output you generate through lawful use of the Service, subject to:

Third-party rights (if any apply), and
Your compliance with these Terms.

Output may be similar to content generated for other users.

8.4 Feedback

If you provide feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, worldwide right to use them without restriction or compensation.

8.5 No-Training Statement

We do not use your Customer Content to train for improving our AI models.

9. Fees, Billing, Taxes, Refunds, Cancellation, and Chargebacks

9.1 Fees and Billing

Certain features of the Service require payment of fees. Fees, billing frequency, and included limits (Usage/Credits/seats) are displayed at purchase and/or in your account.

You authorize us (and/or our payment processors or authorized resellers) to charge your payment method for all fees, taxes, and charges you incur.

Subscriptions renew automatically unless canceled before the renewal date.

9.2 Taxes

You are responsible for applicable taxes unless taxes are collected and remitted on your behalf by the entity processing your payment (as permitted/required by law).

9.3 Price and Plan Changes

We may change pricing, Plans, and included limits from time to time. We will provide reasonable notice of material changes. If required by law, we will obtain consent before charging a higher price.

9.4 Refund Policy (General)

This refund policy does not limit mandatory consumer rights (including statutory rights relating to faulty, misdescribed, or non-conforming digital content/services).

9.5 First-Time Subscription Refund Window (Business Policy)

If you are a first-time subscriber, you may request a refund of the initial subscription purchase within seven (7) calendar days of the purchase date.

Eligibility and limits:

This refund policy applies only to your first-time initial subscription purchase. It does not apply to renewals.
We may deny refund requests in cases of fraud, refund abuse, violation of these Terms, or excessive or abusive use of the Service.
If you have materially used the Service during the refund window – including substantial consumption of Credits or AI generation usage – we may deny the refund or issue a partial refund where permitted by law.

Fees for Usage that has already been consumed (including AI generation and other metered services) are non-refundable to the maximum extent permitted by law. Digital services may be delivered and fully consumed at the time of generation or performance, and no refund will be provided for value already received.

To request a refund, you must contact support@typehero.ai within the 7-day refund window and provide your account and purchase details.

9.6 Renewals

Subscription renewal charges are non-refundable for unused time. Canceling prevents future renewals but does not refund amounts already paid (except where required by law).

9.7 Credits, Metered Usage, Add-ons, and Overage Charges

Credits and metered Usage are consumed as you use the Service.

To the maximum extent permitted by law:

Credits and metered Usage fees are non-refundable once used.
Credits are not redeemable for cash and have no cash value.
If Credits are included in a subscription, they may reset each billing period and do not roll over unless we expressly state otherwise.

9.8 EU/UK and Other Consumer Withdrawal Rights

If you are a Consumer in the EU/UK (or another jurisdiction with similar distance-selling rules), you may have a statutory right to withdraw from a distance contract within a defined period (commonly 14 days), subject to exceptions.

Where legally applicable to digital content/digital services, if you request immediate access/performance during the withdrawal period, you acknowledge that you may lose your right to withdraw once performance begins (or may be responsible for the value already provided), as permitted by law.

Nothing in these Terms limits mandatory consumer rights.

9.9 Chargebacks and Payment Disputes

If you believe a charge is incorrect, you agree to contact support@typehero.ai promptly and provide reasonable details so we can investigate and attempt to resolve the issue.

If you initiate a chargeback or payment dispute:

We may suspend or restrict your Account while the dispute is pending.
We may provide transaction, access, and usage logs to contest fraudulent or abusive disputes.
If the dispute is resolved in our favor, you agree to pay any amounts owed, and access may remain suspended until payment is resolved.

9.10 Termination

We may suspend or terminate your access to the Service if you violate these Terms or engage in activity that could harm us, our users, or third parties.

You may terminate your Account at any time by contacting support@typehero.ai or using available self-service cancellation tools (if provided).

Upon termination, your right to use the Service will immediately cease. Certain obligations (such as payment obligations, intellectual property, disclaimers, limitation of liability, and indemnities) will survive termination.

9.11 Disclaimers

THE SERVICE AND OUTPUT ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT OUTPUT WILL BE ACCURATE OR COMPLETE.

9.12 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEURAL BANANA LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR OUTPUT.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

9.13 Indemnification

You agree to defend, indemnify, and hold harmless Neural Banana LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

Your use of the Service or Output
Your Customer Content
Your violation of these Terms
Your violation of any law or any rights of a third party

10. Changes to the Service and Terms

We may modify or discontinue the Service or update these Terms from time to time. We will provide notice of material changes. Your continued use of the Service after changes become effective, constitutes your acceptance of the new Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of laws principles. Any disputes arising from these Terms or the Service shall be resolved exclusively through binding arbitration conducted in Minnesota, in Ramsey County, in accordance with the rules of the American Arbitration Association.

12. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and Neural Banana LLC regarding the Service.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Force Majeure: We are not responsible for any delay or failure to perform resulting from causes outside our reasonable control.
